Lions Tap settles beef with McDonald's

Bonnie Notermann, a Shakopee resident who has owned the restaurant with her husband Bert since 1977, said she couldn't disclose the terms of the settlement. "It's a mutually beneficial resolution," she said, " amicable to both sides." Notermann couldn't say whether McDonald's was required to drop the slogan in its advertising, but said people will be able to draw an assumption of what happened.

Lions Tap settles beef with McDonald's

Popular local burger eatery Lions Tap has reached a settlement with McDonald's Corporation over the hamburger giant's use of the slogan "Who's Your Patty" in a multi-million advertising campaign for Angus burgers.

In documents filed in federal court today, the Eden Prairie restaurant withdraws its suit, which asked for a financial judgment and McDonald's to quit using Lions Tap' trademarked phrase in all advertising.

Bonnie Notermann, a Shakopee resident who has owned the restaurant with her husband Bert since 1977, said she couldn't disclose the terms of the settlement.

"It's a mutually beneficial resolution," she said, " amicable to both sides."

Notermann couldn't say whether McDonald's was required to drop the slogan in its advertising, but said people will be able to draw an assumption of what happened.

The restaurant, located along old Highway 212, acquired a Minnesota patent for the phrase and filed a federal patent application shortly before it filed its lawsuit in late August.
