Remax tries to liquidate franchisee

One Tree Hill Realty is a former franchisee of Remax, an American-originated real estate agency that charges agents $2000-3000 a month but lets them keep their full commission.

Remax NZ is attempting to liquidate One Tree Hill Realty, due to an unpaid debt but the former franchisee says the amount is seriously disputed.

One Tree Hill Realty is a former franchisee of Remax, an American-originated real estate agency that charges agents $2000-3000 a month but lets them keep their full commission.

Most agencies have the estate agents on a base salary, keeping a portion of each sale’s commission.

One Tree Hill Realty director Patrick Neil O’Connor says the $100,000 Remax says it is owes is seriously disputed.

“Our position is that as it’s a franchise dispute it affects the quantum amount owed," Mr O'Connor says.

"If there is any chance the quantum amount will be affected then it’s not fair."

Remax NZ regional director Chris Chapman says that One Tree Hill Realty is no longer a franchisee.

“It owes a significant amount of money that has been unpaid for some time now,” Mr Chapman says.

At the High Court on Friday, the hearing was adjourned to June 29, 2009.
