Police may be used to evict franchisees

Minister Norm Sterling’s office has cancelled today’s meeting with 2 Grand & Toy franchisees, Joe Tascona, MPP Barrie-Simcoe-Bradford, the minister and the Canadian Alliance of Franchise Operators (CAFO).

CAFO represents the policy interests of 40,000 Ontario franchisees as well as providing consulting services to Grand & Toy and Country Style franchisees. Les Stewart, CAFO's president, was quoted in a December 15th Toronto Star article.

Twenty-two Grand & Toy franchisees will be leaving their stores on December 31st because the franchisor has chosen not to renew their contracts or compensate them for the appropriation of their businesses.

The Ministry of Consumer and Commercial Relations is responsible for Ontario’s franchise law, the Arthur Wishart Act (Franchise Disclosure), 2000.

Country Style Donuts is currently under creditor protection under the Companies’ Creditors Arrangement Act.

A request was made this morning of the Superior Court of Justice to grant a further order to their Initial Order dated December 13, 2001.

Today, Stikeman Elliott, solicitors for the applicant, requested Court authority in “directing specific franchises to comply with the Initial Order and directing the police to assist the court-appointed monitor [Deloitte & Touche] in closing those franchises.”
