Harris Government Refuses to Stand Behind Small Business Owners

Queens Park – Marie Bountrogianni, MPP for Hamilton Mountain today asked the Minister of Consumer and Business Services to bring forward amendments to the Arthur Wishart Act that would offer greater protection to entrepreneurs in franchise relationships. “This government needs to recognize that franchisees are in a dependent relationship. The fact remains that the majority of problems occur after signing the contract” stated Bountrogianni.

The Minister (Hon. Norm Sterling) seems to think the current act is adequate. What the Minister didn’t say, was that when legislation was being drafted witnesses warned that Ontario was introducing a 30 year old disclosure act that in other jurisdictions has been shown to be insufficient and that good faith offered in Bill 33 is not strong enough to protect franchisees.

“If a corporation wants to suddenly revoke a franchise for no apparent reason it would make common sense that sufficient notice and financial compensation should be offered. This is not the case in Ontario. The only recourse Ontario franchise owners have is through civil litigation” stated Bountrogianni.

Clearly there is a problem.”
